Clarification on the new Private Rented Tenancy Agreements

CLA and SAL have issued clarification on the new PRT (Private Rented Tenancy Agreement) when it is implemented circa December 2017.  Many landlords have already questioned whether it is going to affect any current Short Assured Tenancies i.e. when they are due to be renewed, will they have to change to a PRT?

SAL have confirmed the following as at 10th April 2017:

Legal opinion had been divided on whether a short assured tenancy which is renewing on a contractual basis (typically on a month to month basis) would become a new style Private Residential Tenancy (PRT) at the first contractual renewal after the new tenancy legislation is implemented (expected to be in December 2017).

SAL has been in discussions with the Scottish Government on this matter and we are pleased to report that the government has confirmed it will issue legislation to ensure that tenancies of this type will not become PRTs. They will continue as short assured tenancies in perpetuity until terminated by the landlord or tenant.

As ever, SAL will advise members and update our member resources when the new tenancy legislation is implemented.
